Privacy statement

1. Introduction

This Privacy Statement of Go Anime applies to all processing of personal data in the context of the streaming platform Go Anime.

Go Anime is committed to privacy and the protection of personal data. The way we process personal data is in accordance with applicable laws and regulations, including the General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter the “AVG”).

In this Privacy Statement, we explain what data we collect in what way, for what purposes and on what basis. In addition, we explain what rights you have and how you can exercise these rights.

We may amend this Privacy Statement from time to time. We advise you to consult the Privacy Statement regularly. If material changes are made, Go Anime will provide more prominent notice. This Privacy Statement was last amended on Jan. 03, 2024.

2. Processor and contact

The processor responsible for the use of your personal data is Go Anime, based in Amsterdam and with offices at Arie Biemondstraat 111 (KVK 63758237). 3. Collection and processing of personal data.

Go Anime obtains personal data in different ways that it uses for different purposes.

Creation and use of account on the Go Anime service

In order to use Go Anime, you need to create an account. The following (personal) data must be entered:

- E-mail address

- password

We use this data to create the account and to give you access to Go Anime. The basis for processing your personal data in this context is the execution of the agreement with you.

Surfing behavior

We also collect your IP address and/or information about your browser, which parts of our website you visit and/or how you use the website. We use cookies for this purpose. We can use the data collected with these to optimize our website and services. In our cookie declaration you can read more about which cookies are placed for which purposes and by which parties.

Contact with customer service

When you contact our customer service, you provide certain contact information. We use this data to handle your question or request, in order to execute the agreement with you. We may store your question to better assist you later and to improve our products and services, the basis of which is Go Anime's legitimate interest to improve its services.

Participation in customer panel / surveys.

If you participate in a survey by Go Anime, we process, among other things, your contact information and your input regarding the service or product to be surveyed.

The results of the survey are used by us to improve our products and services. The legal basis for this processing is the performance of the agreement.

4. Retention periods

Go Anime does not retain personal data longer than necessary for the purposes for which they are collected or processed, unless longer retention is necessary to comply with a legal obligation.

More specifically, we use the following retention periods:

The (account) data of our customers and subscribers are kept for 2 years after deletion of the account in question.

With regard to inactive users with an account, we apply a retention period of 2 years, after which a reminder is sent as to whether the person concerned still wishes to make use of their account, including a deadline for responding. In the absence of a timely response, the personal data linked to the account will be deleted.

For cookies and similar techniques, we apply a maximum lifespan of six (6) months. (Personal) data collected through cookies, such as information about your internet usage, are also kept for a maximum of six (6) months.

For the data we collect for purposes such as supplying products and services and invoicing, to process orders and to inform you about their progress, we maintain a retention period of up to 2 years.

If you contact customer service, your personal data will be retained by us for up to 2 years after our last contact.

If you participate in a survey or customer panel, the data you provide will be retained by us for up to 2 years. Your contact information will be kept until you unsubscribe from the customer panel.

5. Provision of data to third parties

Companies that are part of the Go Anime service , namely Periscoop film B.V., may grant each other access to your data based on Periscoop film B.V.'s legitimate interest in efficient and effective business operations. All companies within the Go Anime group will provide the same level of protection. Your data may be used by the companies that are part of Go Anime, among other things, for the performance of the agreement(s) with you.

Processors

Go Anime may use the services of third parties to process your data in accordance with this Privacy Statement. These third parties hereby act as processors. Go anime ensures that these parties offer sufficient guarantees with regard to technical and organizational security measures. Third parties acting as processors for Go anime have entered into a processing agreement with us, which includes that they will only process your data at the behest of Go anime.

Your data may also be passed on to third parties because we need to execute an agreement with you or if it is necessary to fulfill agreements with you. In addition, we provide your data to other parties that we need as part of our services.

Otherwise, Go Anime only provides data to third parties with your express consent or if it is required to do so under laws and regulations, it is compelled to do so as a result of litigation and/or in the event it deems it necessary to protect its own interests and/or the interests of third parties.

6. Data Security.

Go Anime takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized modification of personal data. Only persons who, in view of their function, need access to your personal data can access it. All these persons have a duty of confidentiality.

7. Transfer

Go Anime may use the services of third parties to process your data in accordance with this Privacy Statement. In principle, it uses (cloud) solutions hosted within Europe. Nevertheless, these parties may be located outside the European Union or may (in the future) use servers located outside the European Union.

To ensure your privacy, Go Anime will only transfer your personal data in accordance with applicable regulations for transferring personal data to countries outside the European Union. This means that it will transfer your personal data to third countries only if the European Commission has decided that the third country in question ensures an adequate level of protection and/or if other appropriate safeguards are provided, such as unmodified standard data protection clauses approved by the European Commission, with additional measures if necessary. The level of personal data protection rights in these countries may be lower than in the European Union. If necessary, we request your consent for this transfer.

8. Your Rights

You can view your personal data through your account. If you wish to manage, modify and delete data, please contact our customer contact center: info@Goanime.nl

The AVG grants you the following rights with respect to your personal data processed by Go Anime:

Deletion. If you want Go Anime to delete your personal data and/or your account, you can request us to do so. It is possible that some personal data may be retained by Go Anime after the deletion request, for example if this is necessary for the processing of orders placed or if there is a legal obligation to retain the data.

Objection. You can object at any time to the use of personal data for direct marketing purposes and/or the (further) receipt of (certain) marketing information. We will then not send you (further) marketing information. The newsletters and mailings we send you, as well as other marketing information sent by us, also include an unsubscribe option. When we process data based on the legitimate interest of Go Anime, you can object to this processing of your personal data. We will cease processing unless there are legitimate grounds that outweigh your interests.

Restriction of processing. You can ask us to restrict the processing of your personal data if you have a legitimate reason to do so, for example if you feel that we are processing your personal data unlawfully or incorrectly, or if you have objected to the processing of personal data by Go Anime.

Data portability. You have the right to transfer your personal data in a structured, common and machine-readable form (or have it transferred) if the processing of personal data by Go Anime is based on your consent and is performed via automated processes.

Withdrawal of consent. If any processing of your personal data is based on your (explicit) consent, you have the right to withdraw this consent at any time, without prejudice to the lawfulness of the processing based on the consent before its withdrawal.

Complaint. You have the right to file a complaint with the Personal Data Authority.

A request can be made at info@goanime.nl Go Anime will assess this request at the latest within four weeks and let you know what will happen with the request.

9. Transfer of business.

In the future, one or more parts or assets of Go Anime may be transferred to a third party or Go Anime may merge with a third party. In that case, your personal data may also be transferred to this third party. Go Anime will always inform you in advance in such a case.
