Website Terms and Conditions
These Terms and Conditions apply to any use of the Website. By using the Website, the user accepts the applicability of these Terms and Conditions.
Article 1 Definitions
1.1. Go Anime, having its registered office at Arie Biemondstraat 111, 1054PD in Amsterdam and registered with the Chamber of Commerce under number 63758237. Go Anime can be reached via the email address info@goanime.nl. 1.2. Content: all content, in the broadest sense, including but not limited to films, images, illustrations, texts, data, information and other (audio) visual material available on the Website.
1.3. Service: the portal provided by Go Anime for viewing Content, including all features, recommendations and ratings, the Website and user interfaces and also all Content and software connected to portal.
1.4. User: the natural person who visits or uses the Website.
1.5. Terms and Conditions: the present General Terms and Conditions of Goanime.
1.6. Website: the Go Anime website, located at www.goanime.nl / www.goanime.be
Article 2 Customer name subscription and “pay per view” options
2.1. In order to use portal and access Content, User must create a Customer Name account and sign in.
2.2. Minors may use portal only with the consent of their parents or legal guardian.
2.3. User is responsible for the confidentiality of his/her account and password and for restricting access to his/her device (computer, laptop, tablet or smartphone). Membership is strictly personal. It is not allowed to share membership and/or login details with others.
2.4. To use portal, User needs internet access and must have a recent, valid, accepted payment method specified. Through the specified payment method, membership fees will be charged.
2.5. User agrees to pay the established fees to access content.
2.6. Payments are processed through Twikey, and the user agrees to the terms and conditions of this payment gateway.
Article 3 Duration and termination
3.1. The Go Anime membership is in principle entered into for one month. The membership is always renewed monthly, unless User cancels his membership.
3.2. User may cancel membership at any time through the Website. After cancellation, User retains access to portal until the end of the monthly billing period. The account will be closed automatically thereafter. User will then no longer have access to the Content.
3.3. If the membership is not cancelled after it is automatically renewed, the subscription fee of the next period will be charged through the specified payment method.
3.4. Payments are not refundable and Go Anime does not offer refunds or credit for partial membership periods or Content not viewed.
Article 4 Payment.
If you choose an online direct debit or sign a contract digitally, you will be redirected to our partner Twikey for signing the authorization or contract. By using this service, you agree to Twikey's Terms and Conditions. Consult Twikey's General Terms and Conditions here.
4.1. By starting a Go Anime membership, the User authorizes Go Anime to charge monthly subscription fees and other possible charges related to the use of portal, such as taxes, at the then current rate.
4.2. Subscription fees, including any taxes, are debited monthly via the payment method selected by User at the beginning of the membership period, counting from the day on which the membership was started unless Go Anime agrees otherwise with User through, for example, a special offer. Go Anime reserves the right to change the payment date, for example if an amount could not be debited or if the membership started on a day that does not occur in a given month.
4.3. User can change the payment method through the Website. When the User updates the payment method, the User authorizes to continue debiting the subscription fees through the updated payment method. Amounts that Go Anime has not been able to collect remain due. If a payment is not successfully processed for any reason, access to portal may be suspended until a valid payment is obtained.
4.4. Go Anime reserves the right to change the price for portal from time to time. The User will be notified of the upcoming change in price at least 30 days prior to the price change.
4.5. User can opt for so-called “pay per view” option in addition to subscription form.
4.6. After successful payment, the user will get access to the paid content for the specified period or number of views.
4.7. Payments for “pay-per-view” content are final, and no refunds will be issued unless otherwise specified by the Service Provider.
4.8. Users may view content for personal use only and may not further distribute, reproduce or resell it.
Article 5 Use of portal
5.1. Portal and all Content are exclusively intended for own personal and non-commercial use. The Content can only be viewed in the countries of the Netherlands and Belgium and in geographical locations where Go Anime offers the portal and makes the Content available.
5.2. The available Content that can be viewed may vary from time to time. For example, new titles are added all the time. Titles may also disappear, without prior notice. Go Anime therefore reserves the right to change, replace, or remove the available Content and to otherwise make changes to the way Go Anime offers its Service.
5.3. Go Anime reserves the right to change the availability of portal, for example by placing restrictions on the number of devices on which membership can be used.
5.4. All rights related to portal, including but not limited to the Content, belong to Go Anime and its licensors. Users obtain a limited, non-exclusive, non-transferable license to use portal and view the Content.
5.5. User may not reproduce, archive, distribute, modify, display, publish or otherwise disclose, license or offer for sale any Content except as expressly permitted in these Terms.
5.6. As the User directly accesses the Content, no right of withdrawal can be invoked. This is of course separate from the User's right to terminate portal at any time as regulated in Article 3 above.
5.7. Go Anime may suspend, terminate or limit the use of portal and membership without notice if User, in the opinion of Go Anime uses portal or the Website in an illegal, improper manner or in violation of these Terms and Conditions.
Article 6 Image Quality
6.1. The image quality of the Content may vary by device and may be affected by various factors, including your location, available bandwidth and/or the speed of your Internet connection. Go Anime makes no guarantees regarding the image quality and in no case will be held to any refund due to low image quality due to the aforementioned factors. Article 7 Privacy
7.1. By using the Website and portal, personal data may be processed. Go Anime handles the personal data obtained with care and processes them exclusively in accordance with its privacy policy, which is part of these Terms and Conditions and which can be consulted on the Website www.goanime.nl and www.goanime.be.
Article 8 Miscellaneous
8.1. Go Anime is entitled at any time to unilaterally modify these Terms in whole or in part. The amended Terms and Conditions will come into effect 30 days after they have been published on the Website and User has been notified of them by email, unless another effective date is indicated. The most up-to-date version of the Terms can be consulted on the Website at any time.
8.2. Information related to User's account (such as invoices, changes of password or payment methods, confirmation messages, notifications) are sent exclusively in digital form via the email address User has provided.
8.3. By creating an account, you consent to be notified of new additions via the monthly newsletter.
8.4. Nullity or nullification of one or more provision(s) of these Terms shall not affect the validity of the remaining terms.

8.6. User can communicate any complaints to Go Anime via the contact form. Go Anime will make every effort to respond to the complaint as quickly as possible.
Article 9 Applicable Law and Dispute Resolution
9.1. These Terms and Conditions and the Agreement between User and Go Anime are exclusively governed by Dutch law. Any disputes, of whatever nature, unless otherwise required by law, will be submitted exclusively to the competent court in Amsterdam.
